On October 28th, the Ministry of Environmental Protection sent a letter to abolish or modify 49 environmental protection department regulations and normative documents, such as the Regulations on the Administration of Reporting and Registration of Emission Pollutants, and solicit opinions from local environmental protection agencies.
The clean-up work of this regulation is based on the spirit of the Circular of the General Office of the State Council on Relevant Issues Concerning the Clearance of Regulations. It is obviously inconsistent with the existing laws and regulations that the regulations of the environmental protection agencies are obviously not adapted to the requirements of economic and social development, and the regulations are not clearly inconsistent. Coordinated documents are repealed and modified. Among them, 43 regulations and normative documents, such as the “Administrative Regulations on the Reporting and Registration of Emission Pollutants†and the “Administrative Measures on the Import and Export of Ozone Depleting Substancesâ€, are to be abolished, mainly including some management measures and notices related to environmental protection work issued prior to 2008. Documents and the reply to questions such as sewage charges.
The “Management Regulations on Vehicle Exhaust Pollution Supervision and Management†and the “Prevention and Control of Tailings Pollution Environment Management†and other six administrative regulations and measures are to be amended. The letter also provides clear opinions on the deletion and modification of specific provisions, such as the promulgation and implementation in 1992. In the Regulations on the Control of Environmental Pollution Caused by Tailings, the provisions for the handling of violations will be amended in accordance with the "Law of the People's Republic of China on the Prevention and Control of Environmental Pollution Caused by Solid Wastes" implemented in 2005, and penalties for violations shall be increased.
